I think it's because you have set the minimum fan speed to 100% with L1

in the gcode console and report here what it says.Can you make a video showing what you're seeing?
Can you share your full config?
Did this happen when updating to the beta?

it only happens with 3.5.0-beta.2 if i fall back to beta.1 the problem disappears with no config.g change

I think I see another problem. You've set the tool fan as fan1, but your fan command is defining fan0.
Change F1 to F0 in the tool definition.
Do you have multiple tools? You're defining tool1, but counting starts from 0.
